Tshirt Design Competition – Terms & Conditions

“ARTY OUTFIT” – July 2017 Challenge of the Month Terms and Conditions of Entry:

  1. All Entrants must read and agree to the entirety of these terms and conditions. To indicate that they have read and agreed to the below Terms and conditions, the phrase ‘I have read and agree to the terms and conditions for this Tshirt design competition found at http://jazzastudios.com/ShirtDesignTerms’ must be pasted/typed at the top of the Newgrounds description for your entry. This serves as an acknowledgement that you have read all of the information below and agree to be bound by the Terms and Conditions as laid out here.
  2. Entry to the Challenge of the Month is purely voluntary. Participants agree that they will not seek remuneration of any kind for their submission’s inclusion or use on the DrawWithJazza YouTube Channel or for any other commercial purposes. By entering this competition every entrant agrees to give permission without reservation, and in perpetuity, and without fee or remuneration, to Jazza Studios for commercially selling their entry designs on tshirts, and retain any and all proceeds of these sales. Jazza Studios may or may not chose to utilize these permissions. By entering the competition, the entrant agrees not to seek any compensation for Jazza Studios use of the entered designs.
  3. Josiah Brooks (aka Jazza)’s decisions re the winners and prize recipients in this contest are final and entirely his decision. His decision is final and cannot be questioned or refuted in any way.
  4. For this competition only there are monetary prizes. To qualify to receive the monetary prize, each Open category finalist MUST specify and have access to a PAYPAL account. Prizes will be transferred in US DOLLARS only and only to a specified PAYPAL ACCOUNT. This is a nonnegotiable condition of receipt of the funds. Should a finalist not specify and provide their PAYPAL account with 30 days of Jazza Studios request, they will forfeit the right to any money or prize deriving from this competition, from the sale of their design, and from Jazza Studios.
  5. In order to be considered open category entrants/participants must send a transparent PNG file of the design via email to [email protected]
  6. Jazza will chose the three finalists. To determine the winner Jazza Studios will sell the three finalists designs on Teespring. Each of the three chosen finalists will have the ability to receive 50% of Jazza Studios profits (After Teespring’s fees) for THE ENTRANTS OWN SHIRT DESIGN (and not for the entire campaign or others shirt designs), for this limited time campaign, but not for any future campaigns or any future tshirt sales. The design with the highest number sales will be the winner of the competition. Only verified sales on the Jazza Studios owned Teespring campaign will count towards the total number of sales, that form the basis for deciding upon the winner.
  7. The entrants have been granted permission to use Jazza Studios and Jazza’s intellectual property for the purposes of this competition only. Entrants may not use the intellectual property of Jazza Studios for any other purposes. Entrants/participants agree they will not sell tshirts or products that contain Jazza Studios intellectual property.
  8. Jazza Studios will cover the initial postage cost of prizes being sent out, but will not be responsible to pay for any duties or import tax that may result based on the recipients region.
  9. Prizes may have a processing delay of around 4 months. After this time winners are asked to email Jazza Studios to follow up on the prize status.
  10. Jazza Studios takes no responsibility for prizes lost or damaged in transit and is unable to replace them.
  11. If a winner does not contact Jazza Studios to claim their prize within 1 month after the initial winners announcement, the entrant loses their claim to the prize.
  12. Participants may not win the same prize or a prize of lower value twice in one year, however a formally prize winning participant may continue to enter the challenge of the month, and may be eligible for a prize of a higher value if they are deemed as the winner.
  13. If Jazza chooses to award a participant a winning place in the same category after a year has passed to the same participant (if they are judged as being the worthy recipient), Jazza reserves the right to withhold the prize itself if he wishes to pass it on to the next in line in the prize recipient hierarchy. Jazza may if we wishes, provide an alternative prize of equal or lesser value, but this is up to his own discretion.
  14. Jazza Studios will, to the best of its ability, include any and all eligible entries submitted to the Challenge of the Month, but participants acknowledge that their entry may also not be included. Reasons for this include but are not limited to technical difficulties or any questionable content, including but not limited to questionable use of intellectual property and adult themes. Jazza reserves the right to withdraw entrants to the competition as his own discretion.
  15. Through entering the competition, the entrant/participant warrants that they have permission and rights to use and/or own all intellectual property contained in their submission. Any questionable or illegal entries are solely the fault of the creator/entrant. Entrants/Participants to the challenge of the month acknowledge that if their work breaches copyright of the Intellectual Property of any other party and that party pursues legal action, the participant in question is solely liable for the unauthorized use of the content in question and all legal ramifications will be directed to the entrant/participant.
  16. When submitting an artwork to the challenge of the month by following the competition specifications and entry guidelines, participants acknowledge that they have read and agree to these terms and conditions.
  17. Any legal disputes arising from this competition. it’s entries or results will be mediated. litigated or resolved under the legal jurisdiction of Melbourne, Victoria, Australia.
